Foley was sent off early in the second half of the Diesels' 34-6 to Brothers last Saturday.
He was subsequently issued with a high-grade charge of dissent towards referee Ben Whitby, where the charge carried a base penalty of 300 points, or a three-match suspension.
But an early guilty plea and a clean record helped Foley escape suspension and he is free to face the Dragons at Laurie Daley Oval on Sunday week.
While the discount for his 10-year clean record helped escape suspension, Foley will wear carry over points for the next 12 months.
His inclusion will be massive for Junee as they look to keep their top five hopes alive against the fifth-placed Dragons.
The Diesels are two points back in seventh spot approaching the halfway mark of the season.
