David Oliver, 22, appeared before the court via video link from the Junee Correctional Centre on Friday morning in an attempt to convince the judge his original sentence of eight months’ jail was too severe.
Oliver told the court he had been on ice at the time of the offence, but had used his time in jail to rid himself of the substance.
“I’m not so naive to think there’s not drugs in jail, Mr Oliver,” Judge Gordon Lerve told the offender.
“There are probably more drugs in jail than outside,” Oliver said.
“But I’ve used this time in jail to get off it.”
Oliver’s appeal was unsuccessful, with Judge Lerve noting that the assault was serious and his criminal record was extensive enough to warrant the initial sentence.
