THE battle for little Ali Allarakhia appears set to turn into an overseas court tussle between his Wagga mother and Indian-born father who both want custody of the three-year-old.Ali’s mother, Carla Allar-akhia, 24, has not seen her son for almost two months since he was kidnapped in India by his father.Ali was on holiday in India with his father, Shabaz Allarakhia, and his Austra-lian grandmother, Glenda Gannon.Yesterday, Mrs Gannon said the Indian court had again adjourned Ali’s case until later this month. The family has lawyers in both India and Australia who are fighting to get Ali, an Australian citizen, returned to Wagga.“Shabaz let Carla talk to Ali on the phone, but it wasn’t for long and that was nearly three weeks ago. He wanted her to send over papers to sign Ali over to him but she wouldn’t and there hasn’t been any contact since then,” Mrs Gannon said.“It’s a pretty intense time and pretty stressful for everyone.”Mrs Gannon, Mr Allarakhia and Ali were supposed to have returned to Wagga in late September under an Australian Family Court order. On September 23, the night Ali was kidnapped, the trio had been staying in a motel in Mumbai.Mr Allarakhia told Mrs Gannon he was taking Ali downstairs to get a drink at the restaurant. They never returned. The next court date has been set down for November 14 in India.
