Funnell, who did not appear in court, is charged with intimidation intending to cause physical or mental harm in relation to an alleged altercation at his Collingullie property on October 8.
A six-week adjournment to allow for representations was requested by solicitor Kevin Foley, who represented Funnell, when the case was mentioned for a second time in Wagga Local Court on Wednesday.
“We indicated on the last occasion that we would be seeking representations for the charge to be withdrawn,” Mr Foley said.
Wagga Court registrar Paul Fernon was told Funnell was a “well-known member of Wagga City Council” when Mr Foley was asked if his client was present in court.
The case will return to court on March 7.
