A WARRANT issued for the arrest of an alleged armed robber who failed to show up in Wagga Local Court last week was withdrawn on Wednesday after it was learnt he did not appear because he was in prison.
Gavin Pallister, of Young, is alleged to have used a cricket bat to bail up an attendant of a Shell service station at Tolland on April 23.
On bail following his arrest in July, 25-year-old Pallister was due back in court on October 15, but did not front court.
Pallister's solicitor, Chris Murnane, said his client was in the Wellington Correctional Centre for another matter.
His application for the arrest warrant to be cancelled was granted.
Mr Murnane told magistrate Megan Greenwood the prosecution's brief of evidence was complete and had been served on him.
The case has been adjourned until December 3 to allow time for Mr Murnane and prosecutors to hold a case conference.
Bail was not applied for and was formally refused.
