A MAN who drove from Gundagai to Wagga while drunk avoided overtaking a marked police vehicle because he said he needed to urinate.

Michael Richard Keith Radwell, 28, was fined $880 and disqualified from driving for 18 months in Wagga Local Court today, pleading guilty to driving with a high range PCA.
Police alleged in their facts Radwell was travelling on Oura Road at 11.50pm on August 16, approaching the rear of a marked police vehicle that was also travelling west.
Radwell turned high beam down within 50 metres of approaching the police vehicle and backed off.
Police pulled over to allow him to pass, but he turned left onto Hale Street instead of going past the police vehicle.
He was subsequently stopped and told police he was going to Estella.
When they pointed out to him Hale Street was in the opposite direction of Estella, he stated, "I was going to stop for a piss."
The police facts outline Radwell smelt of alcohol and he was unsteady and stumbling.
Radwell then returned a positive reading of 0.172 at Wagga police station.
Radwell's solicitor Kevin Foley submitted to magistrate Michael Antrum it was his first offence and tendered character references.
"There was actually no danger to the public," Foley said.
"Yes, there was potential for danger, but there was no actual danger to the public."
Antrum considered Radwell to be of good character and a useful employee.
"Why you thought you'd get away with it, I have no idea," Antrum said.
"Even if it was a one-off, which this may have been, you're now paying for it."
The conviction was recorded.
