David Edward Blake was driving a taxi when it hit 51-year-old Junee man Mal Hackett on Red Hill Road at Glenfield Park in October 2019.
Earlier in the year, legal parties argued whether a video of a police interrogation could be tendered during a trial.

Then in August, Judge Gordon Lerve ruled that the video from question 56 would not be permitted as evidence in court.
During his ruling, he said it was a "complete failure" of one of the police officers to not pass on the information to the interviewers about Mr Blake's acquired brain injury.
The matter returned to Wagga District Court on October 8, when a representative for the Director of Public Prosecutions advised that would be no further proceedings in this matter.
The legal team representing Mr Blake advised there would be an application for costs on October 28.
