A Wagga business owner has faced court over allegedly breaching a public health order.

Richard Moffatt, the co-owner of Meccanico Espresso and Wine, appeared before Wagga Local Court on Wednesday charged with not complying with noticed direction of a COVID-19 ministerial direction.
Senior Police Prosecutor Jason Tozer explained to the court "the direction in its most base form is that businesses comply with a COVID safety plan".
"It requires the provision of hand sanitiser, the QR code your honour has probably seen ... maintaining a register, [and] keeping records," he said.
Magistrate Christopher Halburd elected to recuse himself as he had visited the eatery "regularly".
"An easy fix would be to send it to Albury and Mr Moffatt could appear by phone," he said.
Mr Moffatt also faces an offence relating to development not accord consent. The case will appear at Albury Local Court on April 20.
