The 16-year-old boy will face court, charged with negligent driving occasioning death and learner driver unaccompanied, over the early New Year tragedy.

Five teenage boys aged between 14 and 16 were travelling in a white Toyota Landcruiser when it crashed on Edward River Road at Mathoura, around 35km south of Deniliquin.

Emergency services were called out to reports of the crash around 12.30am on January 9, where they discovered the wreck.

The driver reportedly swerved to avoid hitting kangaroos and lost control of the vehicle, police were told.

A 16-year-old boy died at the scene, while the four teens were not physically injured in the crash.

A crime scene was established and investigations carried out by officers from the Murray River Police District commenced, culminating in charges being laid against the driver.

The 16-year-old will face a children's court on April 7.
