On Monday night, Cr Funnell was censured after being found to have breached the code of conduct by failing to treat his fellow councillor, Vanessa Keenan, with respect at all times via email and in-person communications during 2017.

The code of conduct matter was heard in a confidential section of the meeting that was closed to the public.

However, the names of councillors involved and basic details of the investigation's conclusion were disclosed to the public at the end of the meeting.

Cr Kerry Pascoe objected to how the matter was handled, raising concerns around confidentiality due to councillors' names being used.

"I don't think Cr Funnell was given proper procedural fairness and due process has been breached. I don't think we followed the code of conduct procedures," Cr Pascoe said.

"I've been looking over this and talking to people in local government and this has never happened in this council before and from my reading of the documents, I think the wrong process was put in place after getting information from professionals.

"Placing people's names in the resolution was the main issue. I need to follow this up before taking action. I want to check the whole process out to make sure there is no breach in process."

A council statement said the organisation "follows the process under the administrative procedures for the code of conduct for all code of conduct matters".

"These procedures include provisions relating to council considering a final investigation report and also confidentiality provisions in handling the complaint."

In response to a question whether the council might have breached its procedures, the council stated that every local government in NSW must provide "avenues for a right of review" around code of conduct matters.

"A person the subject of a sanction has the option to request a review of the matter, in the appropriate circumstances, which are set out in the procedures for all councils," the council statement said.

"Council will, therefore, not comment further on this issue as an independent review process exists.

"It is the responsibility of the Office of Local Government NSW to take the necessary steps, including a potential review of the matter, if a written request is made to them."

The council's administrative procedures state that "information about code of conduct complaints and the management and investigation of code of conduct complaints is to be treated as confidential and is not to be publicly disclosed except as may be otherwise specifically required or permitted under these procedures".

Cr Pascoe said the meeting's handling of the complaint against Cr Funnell had not been handled "normally".

"This is the first time it has happened, we have had code of conduct before but they have all been confidential and people only find out because confidential information is leaked," he said.

Cr Funnell has also claimed that councillors breached meeting procedures when the code of conduct matter was heard at Monday night's meeting.
