A new adult shop that has been subject to an investigation by Wagga City Council appears likely to gain development approval on Monday night.

Inquiries into the Flirt Adult store on Baylis Street were made in April after doubts were raised over its compliance with planning regulations.
The proposed location is approximately 200 metres from the Greek Orthodox Church in Tompson Street, which does not comply with the 'restricted premises' control that requires such developments to be at least 400 metres away.
However, an overriding provision could see it approved.
According to the council agenda for July 22, the development is not visible from the church and likely would not impact the place of worship due to the store being discrete in appearance.
"It is further noted that the existing restricted premises in the city is also located about 200 metres from a church, and about 80 metres from an educational establishment (Indie School) ... despite these land uses all being within 400 metres of that restricted premises, there is no evidence that there is any incompatibility between the uses, or any impacts born on these 'sensitive uses'," the report read.
"The development is largely consistent with the controls of the Wagga Development Control Plan 2010, and where it is not, the variations to the controls are justifiable and reasonable, and the development meets the underpinning objective.
"The proposed development does not result in unacceptable impacts and is considered to be in the public interest."
