Manager of city development Paul O'Brien confirmed on Wednesday that inquiries had begun into the opening of the new shop in Baylis Street.
"Council is of the opinion that the Flirt Adult Store is a restricted premises and that the premises are being used for a purpose for which a planning approval is required but has not been obtained," he said.
"Council is in the process of investigating the reported opening of the store to determine appropriate actions to address the issue and is unable to provide further comment at this time."
Multiple attempts were made to contact the owner of Flirt Adult Store.
Another local adult store is Simply Risque, whose current owner has been in the business of supplying adult products for 12 years.
She said, in that time, she has followed every rule and regulation set out by the council.
The business woman, who wished to remain anonymous for privacy reasons, said the sign outside the store barring access to those under 18 means the store is restricted.
"They had already been refused for restricted premises before," she said.
"If they're allowed to stay and operate then it means any store can sell these products.
"There is a place for adult products and that's why we have laws and regulations."

The Wagga Local Environmental Plan 2010 states a restricted premise limits access to only patrons or customers who are over 18 years of age.
Restricted premises include sex shops, but not pubs, hotels or motel accommodation, home occupation (sex services) or sex services premises.
As of Wednesday afternoon, a sign on Flirt Adult Store's door stated "restrictions (sic) publications area".
"Persons under 18 may not enter," the sign read.
"Members of the public are warned that some material displayed in this area may cause offence."
A social media post also advertised 'Kinky in the Country Classes' to be held at a later date in store.
In February, the owner of Flirt told The Daily Advertiser that he was "very confident" that the development application would be granted.
"Why else would we be posting employment ads?" he said.
