A Tolland man who repeatedly swore at a magistrate during his court hearing has been denied bail.
David Leonard White, 45, fronted Wagga Local Court on Monday via video-link from a holding cell charged with common assault, affray, and shoplifting.
The court heard Mr White was originally granted bail after police charged him with assault and affray after a midday incident on July 9 in Wagga.
However, Mr White was arrested again on Sunday, September 2 and charged with stealing three packets of beef fillets valued between $75 and $100 from the Glenfield Park Aldi.
Mr White’s lawyer made a case for his release on Monday, however, magistrate Christopher Halburd denied the request.
In response, Mr White gave the magistrate the finger and yelled obscene language at him.
Mr White’s lawyer argued that he needed to remain in the community so he could care for his two children, aged 10 and 16, on weekends and continue to undergo treatment for anger management and grief counselling.
However, Mr Halburd said he would be able to access the same services from custody, so there was not enough cause to grant him release.
“There’s no f---ing rehabilitation in jail,” Mr White said in response before swearing at the magistrate again.
Mr White lashed out a third time when the magistrate asked if he was ready to enter his plea and the stormed out of the video conference room.
His lawyer had already been instructed to enter a plea of not guilty to the new charge on his behalf, despite her concession that the prosecution case against her client appeared to be strong.
The court heard the alleged offence was caught on CCTV and witnessed by another customer.
A hearing date of November 6 was set to settle Mr White’s shoplifting charge.
He will also return to Wagga Local Court next Wednesday in relation to his two remaining charges.
