PROSECUTORS will press on with a charge of dangerous driving occasioning death against a man behind the wheel of a car that crashed near The Rock, killing his brother.

Jake Rushby was prepared to plead guilty to the lesser charge of negligent driving occasioning the death of 13-year-old Stephen Rushby, the accused’s solicitor, David Barron, told Wagga Local Court on Wednesday.
But Crown solicitor Rennae Gee rejected the offer, saying the more serious charge would be taken to the District Court.
Rushby, 20, has waived his right to a committal hearing and the case will go to trial on a date to be fixed.
It is alleged Rushby was driving an unroadworthy and unregistered car that overturned on Vincent’s Road on April 17.
