Barbaro ruling appeal

LAWYERS for accused drug baron Pat Barbaro will this week appeal a ruling which saw the father of four sent back to prison earlier this month.On Friday, three judges from Victoria’s Court of Appeal will decide whether to overturn a February 6 decision by a Supreme Court justice to revoke Mr Barbaro’s bail.Mr Barbaro’s solicitor, Joe Acquaro, said he was hopeful of having the decision rescinded and said it had taken a heavy toll on Mr Barbaro and his family.“The whole thing has been a bit traumatic and Mr Barbaro is understandably anguished at being granted bail and then being plucked out and put back in prison,” Mr Acquaro said.“He is separated from his family and is now not able to fulfil his obligations to his employees and the community at large. “So it has been emotionally draining and caused grief to many other people.”While publication of the reasons to revoke bail had been suppressed by the court, Mr Acquaro said Mr Barbaro had lodged an appeal on the advice of his legal team and the case would be fought on “areas of law”.Mr Acquaro said he was grateful to be granted a speedy appeal, saying it often took months for a date to be set.Mr Barbaro, 46, was granted bail in December after his arrest in relation to a shipment of 4.5 tonnes of ecstasy found in tomato tins at Melbourne Port.He was one of 25 people arrested in August over the ecstasy haul and the seizure of 150kg of cocaine. Since returning to his Tharbogang home, Mr Barbaro had been forced to wear an electronic tracking bracelet, report to police twice daily, carry a phone with video capability and abide by a curfew.
