Funnell, 54, was not present when the case was briefly mentioned in Wagga Local Court on Wednesday.
Funnell is charged with intimidation intending to cause physical or mental harm between 10am and 10.25am on October 8 at Collingullie.
The case was adjourned until January 17. Pleas are yet to be entered.
Funnell told The Daily Advertiser when contacted outside court on Wednesday that he was not present because he was waiting for a brief of evidence to be served by the prosecution.
“I am completely innocent – which will be shown if they don’t have the common sense to withdraw the charge,” Funnell said.
“I would like the matter over and done with but we need to let the justice system play its course.”
Funnell said he was the victim in the alleged incident.
“This person was trespassing on my property – I asked him to leave in a robust manner and he wasn’t touched in any physical way,” he said.
