Carl Little, 25, of Mount Austin is accused of shooting a 34-year-old man at a North Wagga house on January 5.
Little is now facing just two charges, discharging a firearm with intent to cause grievous bodily harm and specially aggravated enter dwelling with intent.
A third charge – specially aggravated enter dwelling with intent to inflict grievous bodily harm – was withdrawn in Wagga Local Court on Wednesday.
The facts state the projectile from the bullet remained in the alleged victim’s leg after surgery to remove it was unsuccessful.
Little’s solicitor presented a number of submissions as to why the bail application should be heard, including that his client had been in custody since January this year.
He said his client’s trial date was unlikely to occur until 2018 and was to be defended.
“My client was initially on parole which expired last month,” he said.
“The co-accused are currently both on bail and charged with serious involvement.”
Andrew Hanshaw, who appeared for the Crown, said the wait time was minimised now that Wagga had a full-time District Court.
“The fact that he’s no longer on parole doesn’t change anything in relation to bail,” Mr Hanshaw said.
“A trial within 14 months is not outrageous when we consider what the blow out previously was.”
Magistrate Michael Crompton said he wasn’t satisfied as he denied the application.
“While there has been an influx of time, the amount of time is not extraordinary and I therefore refuse to hear another application,” Mr Crompton said.
Little’s case will be heard by Wagga District Court on September 29, where he is expected to enter a plea.
Another man who was alleged to have been with Little at the time of the shooting – 22-year-old Shyheim Little – is charged with specially aggravated enter dwelling with dangerous weapon.
The Lake Albert man waived his right to a committal hearing on Wednesday and had his bail varied to extend his curfew, also headed to the District Court on September 29.
38-year-old Wayne Mark Murdoch is also charged with specially aggravated enter dwelling with intent in relation to the alleged incident.
