A MAN accused of throwing a drunken punch that led to another man falling to the ground and suffering a fatal head injury will apply to have a witness give evidence at a committal hearing.

Malcolm Clarence Mathers, 29, is alleged to have thrown a punch that led to the death of 34-year-old Terry Wickey in the Ashmont Inn carpark on December 3.
Mathers is also charged with affray, as is his 28-year-old brother, Warren Mathers.
Their solicitor, David Barron, foreshadowed an application to cross-examine a witness when the case was mentioned in Wagga Local Court on Wednesday.
According to a timetable set down by magistrate Erin Kennedy, Mr Barron will lodge his formal application by June 14 and the Office of the Director of Public Prosecutions will reply by June 28.
Ms Kennedy will then determine the application after considering defence and prosecution submissions at a hearing on July 5.
Both accused men are on bail and were in court for their case.
Meanwhile, Mr Barron said he understood the charge against Malcolm Mathers of “assault cause death by person 18 years or more, intoxicated” may be withdrawn and substituted with a different charge.
