Jake Rushby is accused of being the driver of a car that crashed into a tree at The Rock on April 17, killing his 13-year-old brother, Stephen. His case was mentioned in Wagga Court on Wednesday but no decision has yet been made by the DPP over an appeal by Rushby’s defence to reduce the “dangerous driving causing death” charge to the less serious “negligent driving causing death”.
