Chris Hoerler, a Papau New Guinea national, was convicted in 2003 of the manslaughter of seven-month-old Jordan in Wagga three years earlier.
Hoerler's substantive visa that allowed him to live in Australia was cancelled in 2011 and when he was released on parole two weeks ago it was on the understanding he would be deported from Australia.
It is believed the 34-year-old is in custody in the Villawood immigration detention centre.
Immigration minister Scott Morrison told the Ray Hadley radio show on Monday that Hoerler was on the list to be deported, but said he could not elaborate on individual cases.
The Daily Advertiser on Friday asked Mr Morrison's office if it could give an update on Hoerler's situation.
The office replied there was no update at this stage.
