Wagga City Council has been at loggerheads with the Roads and Maritime Service (RMS) over the issue for some time with legislation under Section 138 of the Roads Act requiring signs placed on nature strips to be approved by council.
According to Wagga City Council, no application by RMS has ever been made.
"The Roads and Maritime Service has to date not applied for a Section 138 permit from Wagga City Council," a statement said.
"Wagga council has previously raised the issue of the placement of RMS mobile speed camera car warning signs with the RMS.
"Council requested an explanation from the RMS why the signs do not require a Section 138 permit on council roads as per the Roads Act 1993.
"Council had recently received a response from the RMS on the issue."
Council was unable to provide further information as to what the response from the RMS was.
The RMS said it would issue a response on the matter today.
