THE controversial naked photograph of Lara Bingle has reached mobile phones in t

THE controversial naked photograph of Lara Bingle has reached mobile phones in the Riverina, but it is believed those caught circulating it could be liable to charges under NSW law.

State laws covering mobile phone usage makes it an offence to use a phone in a way that menaces, harrasses or causes offence to another person.

And because Miss Bingle has voiced her disapproval of the picture text message, which she says was taken without her consent when she was 19, it is thought anyone caught passing it on could be breaking the law.

A person found guilty of the offence faces a maximum penalty of three years imprisonment.

NSW Police confirmed yesterday they were not investigating a complaint on behalf of Miss Bingle.

She is reportedly preparing to launch legal action against Brendan Fevola who she claims is responsible for releasing the photo taken of her in the shower to Woman's Day.

The photo's release started a downward spiral for Miss Bingle and her former fianc�, cricketing star Michael Clarke, who announced last week their engagement has ended.
