A WAGGA man facing jail for driving while disqualified has been given time to get proof of a medical condition that might result in him serving a shorter sentence.
Troy Hund, who is already disqualified from driving until 2065, appeared in Wagga Local Court yesterday for sentencing after earlier pleading guilty to driving while disqualified on March 8.
Hund, a 30-year-old labourer, of Raye Street, Tolland, has been in custody at the Junee Correctional Centre since March 9.
Giving evidence yesterday, Hund told the court he was an epileptic.
He claimed nurses at the prison had not given him his medication since he went into custody, and he had suffered two seizures.
Magistrate Anthony Murray said there was no evidence before the court on the claim apart from Hund's testimony.
The magistrate encouraged Hund to get proof of his medical condition because it would be a significant factor in determining the length of the jail sentence Hund would be given.
Hund also told the court he was the step-father of a four-year-old child, the father of an eight-month-old baby and his de facto partner was pregnant again.
Hund will now be sentenced on March 29.
